Terms of Use

Welcome to CommissionIQ ("CommissionIQ," "we," "us," or "our"). By accessing or using our website, dashboard, mobile experiences, integrations, and related services (collectively, the "Services"), you ("Customer," "you") agree to be bound by these Terms of Use. If you do not agree, do not use the Services.

1. The Services

CommissionIQ provides commission tracking, carrier statement reconciliation, hierarchy management, reporting and 1099-preparation tooling for U.S. insurance agencies, FMOs, brokers and independent agents. We may add, modify or remove features at any time.

2. Eligibility & Accounts

You must be at least 18 years old and authorized to act on behalf of any agency or entity you register. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account, including activity by your sub-agencies and agents.

3. Customer Data

You retain all rights to commission statements, carrier credentials, client information and other data you upload or connect ("Customer Data"). You grant CommissionIQ a worldwide, non-exclusive license to host, process and display Customer Data solely to provide the Services. We do not sell Customer Data.

4. Carrier & FMO Integrations

When you provide credentials to connect a carrier, FMO or broker portal, you authorize CommissionIQ to access those portals on your behalf to retrieve commission, policy and producer data. You represent that you have the right to provide such credentials and authorize such access.

5. Subscriptions, Billing & Add-Ons

Paid plans renew automatically until canceled. Add-ons (additional agents, sub-agencies, FMO connections, insurance lines) are billed monthly and prorated. Fees are non-refundable except where required by law.

6. Acceptable Use

You agree not to: (a) reverse engineer the Services; (b) upload data you do not have the right to share; (c) interfere with other customers' use; (d) use the Services to violate insurance regulations or NPN/state licensing requirements; (e) resell the Services without our written permission.

7. Disclaimer — Not Financial or Legal Advice

Commission calculations, recovery estimates and 1099 preparation features are provided as automated tools to assist you. They are not financial, tax or legal advice. You remain responsible for verifying amounts owed, filing your own 1099s, and complying with all applicable laws.

8. Warranty Disclaimer

The Services are provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, CommissionIQ disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, CommissionIQ's total liability for any claim arising from the Services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential or punitive damages, or for lost commissions, profits or revenue.

10. Termination

You may cancel your subscription at any time from your billing settings. We may suspend or terminate your access for non-payment, violation of these Terms, or as required by law. Customer Data is retained for 30 days after termination, after which it may be deleted.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Florida.
